$900K Data Breach Settlement: How to Score Up to $4,200 with Just One Form!

According to The Sun, The deadline is approaching for Americans to claim their share of a $900,000 payout following a data breach involving Paycom. The company faced a class action lawsuit due to its failure to adequately protect the personally identifiable information (PII) of its customers. Although Paycom has not admitted any wrongdoing, the settlement will allow eligible individuals to claim up to $4,200.

Claim Eligibility and Amounts

Individuals who experienced documented out-of-pocket losses due to the data breach can claim up to $2,500 per person. Additionally, if individuals spent up to four hours resolving issues related to identity theft or fraud, they can submit a claim for this time. Claims for time spent will be compensated at a rate of $25 per hour, allowing for a total of $100 to be included in the $2,500 maximum.

For users of Paycom’s payroll services, those who can prove documented losses stemming from fraud or identity theft can claim nearly double that amount, reaching up to $4,200 per person. Furthermore, claimants can also apply for three years of credit monitoring services as part of the settlement.

Details of the Breach

The breach involved unauthorized access to client details through MOVEit Transfer, a secure file transfer application, between July and October 2023. The lawsuit alleges that Paycom did not implement sufficient cybersecurity measures to protect its users’ data.

Key Dates for Claims

  • Final Submission Deadline: November 7, 2024
    Claimants must submit their forms by this date to be eligible for any portion of the $900,000 payout.
  • Exclusion and Objection Deadline: November 7, 2024
    Class members wishing to opt out or object to the settlement must do so by this date.
  • Final Fairness Hearing: December 13, 2024
    This hearing will finalize the terms of the settlement.

Other Recent Data Breach Settlements

This isn’t the only recent payout deadline stemming from a data breach. Oracle America, Inc. faced a class action lawsuit in 2023, leading to a proposed $115 million settlement. Individuals whose personal information was collected and/or sold since August 19, 2018, may be entitled to compensation. The lawsuit alleges that Oracle illegally collected and sold personal data to third parties for advertising purposes without user consent.

The final date to submit claims for the Oracle lawsuit was October 17, 2024. It is currently unclear how much each claimant will receive, as the net settlement fund will depend on the number of eligible claims submitted.

In response to the lawsuit, Oracle has announced operational changes, including discontinuing the collection of user information from forms.
