East River Medical Imaging, a radiology center, is at the center of a class action lawsuit in New York after being targeted by hackers between August and September 2023. The breach reportedly led to the unauthorized access of personal patient information, including sensitive data such as:

  • Procedure information and imaging results

Compensation Details

Individuals whose data was compromised in the breach, as well as those who received a notification about the incident, are eligible to apply for compensation. Claimants have two options for receiving their payout:

  1. Expense Reimbursement:
    Eligible individuals can claim up to $7,500 for losses related to the data breach, including:

    • Bank fees
    • Damages caused by fraud or identity theft
    • Costs incurred for hiring professional services

    To qualify for this type of compensation, claimants must provide documentation of their losses, such as bank statements, receipts, and invoices.

  2. Pro Rata Cash Payment:
    Those without proof of expenses or who prefer not to claim reimbursement can opt for a standard pro rata cash payment. This amount will be calculated from the remaining settlement fund after all other claims have been settled.

In addition to either payment option, all claimants will receive one year of three-bureau credit monitoring to help detect potential fraud.

Important Deadlines

Time is running out for eligible claimants to file their claims, with the deadline to submit a valid claim form set for October 22.
